TERMS AND CONDITIONS OF THE 2019 EATON FAIR SCRATCH & WIN COMPETITION
Eaton Fair Shopping Centre Competition Terms and Conditions.
- Citygate Properties Pty Ltd (ACN 008 775 068) (Citygate) is conducting a Scratch & Win Competition (the Competition).
- By entering the Competition, you (Entrant) warrant that you meet all eligibility requirements and accept these Terms and Conditions.
- Citygate and any tenant of the Eaton Fair Shopping Centre (Sponsor) reserve the right in their absolute discretion to refuse to award any prize/reward to any Entrant for any reason whatsoever, including if the Entrant fails to comply with any of these Terms and Conditions.
- Citygate’s decision is final and no correspondence will be entered into.
Eligibility - The Competition is open to Australian residents aged 18 years or older residing in Western Australia.
- The Competition is open to all eligible persons except employees, officers, contractors, agents, promotional staff or contractors, or advisors of Citygate, Sponsors or any tenant of the Eaton Fair Shopping Centre, or their respective immediate families.
- Citygate may request an Entrant to provide reasonable documentation which establishes an Entrant’s eligibility to enter the Competition including, without limitation, an Entrant’s identity, age and place of residence. An Entrant’s residential post code will determine whether or not he or she resides in Western Australia for the purposes of the Competition.
Competition Period
- The Competition will commence at 09h00 on 21 November 2019 and will expire when all Scratch Cards have been distributed unless declared earlier by Citygate.
- Any entry received before the commencement, or after the expiry of the Competition period will be deemed invalid.
- Citygate will not accept responsibility for late, lost, delayed or misdirected entries.
How to enter
- To enter the Competition, an eligible person must make a purchase exceeding Twenty Dollars ($20.00) and receive a receipt evidencing such purchase (Proof of Purchase) from a store located at the Eaton Fair Shopping Centre.
- For a list of locations (Designated Location) where the scratch cards will be distributed please refer to the Eaton Fair Shopping Centre website.
- The eligible person must deliver the Proof of Purchase and complete a short Competition entry form at the Designated Location at the Eaton Fair Shopping Centre to obtain a Scratch Card.
- An eligible person may enter as many times as they wish for the duration of the Competition but will only receive one Scratch Card per purchase.
Prizes
- A Scratch Card may contain a Prize. Prizes vary in nature and value.
- Prizes pictured in point of sale, online banner or print advertising and in promotional materials and other materials in connection with the Competition are for illustrative purposes only. Actual Prizes may vary in appearance from the prizes pictured.
- The Prize may only be redeemed at a store located in the Eaton Fair Shopping Centre.
- The Prize may not be used in conjunction with any other offer, discount or promotion.
Redeeming a Prize
- To redeem a Scratch Card, go to the relevant store at the Eaton Fair Shopping Centre, see a sales associate, and
show them the Scratch Card.
- All Scratch Cards must be redeemed on or before the date shown on the Scratch Card and will NOT be valid after
that date.
- Before a Prize can be awarded on any Scratch Card, it may be subject to validation by the Sponsor. The Sponsor
shall declare a Scratch Card invalid, and accordingly shall not award a Prize, if: (a) The Scratch Card is counterfeit or has been forged in whole or in part; (b) The Scratch Card is not redeemed by the deadline specified; (c) The Sponsor believes that the Scratch Card has been submitted by a person ineligible to participate in the Competition, as listed in these Terms and Conditions; (d) The Scratch Card is not fully legible or is mutilated, altered, illegible and incomplete or has been tampered with in any manner; (e) The Sponsor reasonably believes that the Scratch Card has not been obtained in an authorised manner; (f) The Entrant presents more than one Scratch Card.
- Scratch Cards are automatically void if counterfeited, mutilated, forged, altered, or tampered with in any way, if
illegible, mechanically reproduced, obtained outside authorized legitimate channels or if they contain printing, production, typographical, mechanical, or other errors, or if they are rendered inoperable due to any type of malfunction, whether technological or otherwise.
- Any person attempting to forge a Scratch Card or to defraud Citygate or a Sponsor in any way in connection with
this Competition will be disqualified and may be prosecuted to the fullest extent of the Law.
- If a Prize is unavailable for whatever reason, Citygate and any Sponsor reserve the right in their absolute discretion to substitute the Prize for a prize of equal or greater value, subject to any applicable statutory requirement.
- The Prize is subject to any additional terms and conditions outlined on the Scratch Card and/or imposed by either Citygate or the applicable Sponsor.
- Citygate is not responsible for any additional costs associated with the use or collection of the Prize.
- The Prize, or any unused portion of the prize is non-refundable, non-transferable and cannot be exchanged for cash.
Privacy
- By entering the Competition, each Entrant acknowledges and agrees that Citygate collects personal information about Entrants for the purposes of:
- including Entrants in the Competition and, where appropriate, awarding Prizes; if the personal information requested is not provided, the Entrant may not participate in the Competition; and
- enabling Citygate to use the information to assist Citygate in improving goods and services and to contact the Entrant in the future with information on special offers or provide Entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. Citygate may share information with its Australian related companies or any other third party who may contact the Entrant with special offers in this way. By entering the Competition, an Entrant agrees that Citygate may use the Entrant’s personal information in this manner. Entrants may opt out by clicking on the “unsubscribe” link in the email or as set out in the SMS/MMS.
- By entering the Competition, Entrants provide Citygate with authority to use their name, likeness, image and/or voice (including any photograph, film, and/or recording of same) in any media at any time or times without remuneration for the purposes of promoting the Competition, the Eaton Fair Shopping Centre, Citygate and/or Citygate’s (or its related entities) products or services. Further, Winners agree to be photographed and participate in all reasonable promotional activities in relation to the Competition and the winning of the Prize.
Limitation of Liability
- To the greatest extent permissible by law, Citygate (including its related entities) and its respective officers, employees, contractors and agents shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to, indirect or consequential economic loss) or for personal injury suffered or sustained, as a result of the Competition or in connection with the Prize.
- If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the control of Citygate which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, Citygate reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion subject to any written directions under applicable legislation.
- The warranty on any goods and services obtained as a result of the Competition remains the sole responsibility of the manufacturer or supplier of the goods or services as applicable.
General
- Citygate reserves the right to suspend, modify or terminate the Competition if the conduct or operation of the Competition is interfered with or disrupted in any way by any cause outside the reasonable control of Citygate. For the avoidance of doubt, any cause which is outside the reasonable control of Citygate includes, without limitation, vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer viruses or technical failures.
- Citygate also reserves the right in its sole discretion to disqualify any individual who Citygate has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. The legal rights of Citygate to recover damages or other compensation from such an offender are reserved.
- Any decision made by Citygate in respect of the Competition is final and binding and no correspondence shall be entered into.
- Any provision of these Terms and Conditions which is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition of unenforceability. That does not invalidate the remaining provisions of these Terms and Conditions nor affect the validity of the provision in any other jurisdiction.
- The conduct of the Competition and these Terms and Conditions are governed by the laws of Western Australia. By submitting an entry, the Entrant submits to the exclusive jurisdiction of the courts of Western Australia.
