EATON FAIR SHOPPING CENTRE “WIN A CAR” COMPETITION TERMS AND . . . CONDITIONS These terms and conditions are applicable to the “Win a Car” competition conducted by Eaton Fair Pty Ltd (ACN 638 021 173) (Eaton Fair Shopping Centre) and any associated company or nominee of Eaton Fair Pty Ltd. By entering the competition, entrants warrant that they meet all eligibility requirements and accept these Terms and Conditions. The competition will commence at 9am on Saturday 1 July 2023 and will close at 5pm on Saturday 9 September 2023. Entry into the Competition is free. The Competition is open to Australian residents aged 18 years or older residing in Western Australia and holding a current valid driver’s licence. To enter the Competition, an eligible person must visit the Eaton Fair Shopping Centre during the competition period and scan the QR code located near the Chery Omoda vehicle display in the Centre and follow the prompts to register online to go into the draw. Only one entry per person is allowed. 4 finalists will be drawn from eligible entries on 12 September 2023 by a representative of Eaton Fair Pty Ltd and will be notified by telephone shortly thereafter. One additional finalist will be drawn from the competition’s social media campaign and will be notified by telephone before close of business on 12 September 2023. To be eligible for the Prize all finalists must be available to be present at the Centre on 19 September 2023 at 10am for the final draw. The winning entrant (Winner) will be drawn on 19 September 2023 by a representative from Chery Bunbury who will make arrangements with the Winner for the collection of the Prize. There will only be one Prize described as a Chery Omoda 5 SUV vehicle. The Winner will be able to choose the colour of the vehicle subject to availability of stock. The Prize includes vehicle licence duty (stamp duty) and 6 month’s vehicle registration which will be paid by Chery Bunbury. Any vehicle transfer fees will be payable by the Winner. The Prize does not include vehicle insurance. Chery Bunbury will be responsible for the vehicle transfer and registration process and Eaton Fair Shopping Centre bears no responsibility for vehicle registration and transfer.     Eaton Fair Shopping Centre reserves the right in its absolute discretion to refuse to award any prize/reward to any entrant for any reason whatsoever, including if the entrant fails to comply with any of these Terms and Conditions. To the extent permitted by law, the Winner takes the vehicle on an “as is” basis, and Eaton Fair Shopping Centre make no representations or warranties that are not expressly stated in these terms. The Prize and collection thereof may be changed at any time and at the sole discretion of Eaton Fair Shopping Centre or Chery Bunbury. The Winner will be required to produce photographic proof of identity and a valid driver’s licence to collect the Prize. If for any reason the competition is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the control of Eaton Fair Shopping Centre which corrupt or affect the administration, security, fairness, integrity or proper conduct of the competition, Eaton Fair Shopping Centre reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition subject to any written directions under applicable legislation. The warranty on any goods and services obtained as a result of the competition remains the sole responsibility of the manufacturer or supplier of the goods or services as applicable. Any reference to Eaton Fair Shopping Centre in these Terms and Conditions includes its related entities. Eaton Fair Shopping Centre reserves the right to suspend, modify or terminate the competition if the conduct or operation of the competition is interfered with or disrupted in any way by any cause outside the reasonable control of Eaton Fair Shopping Centre. For the avoidance of doubt, any cause which is outside the reasonable control of Eaton Fair Shopping Centre includes, without limitation, vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, global pandemic or outbreak of an infectious disease, computer viruses, technical failures or a directive issued by a government authority or a law resulting in Eaton Fair Shopping Centre being closed or shut down. Eaton Fair Shopping Centre also reserves the right in its sole discretion to disqualify any individual who Eaton Fair Shopping Centre has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition.
